Withdrawal Policy for Digital Content

Regardless of the right of withdrawal, you may cancel your Heartwalker membership at any time without giving reasons. The cancellation becomes effective at the end of your current billing period (maximum 1 month from submission) and must be made at least 5 days before the next payment is due.

Cancellation therefore only affects future payments and terminates the contract for the future. A withdrawal, on the other hand, is a statutory right of rescission that relates to the start of a contract. Since Heartwalker provides digital services immediately and you expressly agree to the immediate start of performance, the statutory right of withdrawal expires after the start of the contract (see below).

1. No right of withdrawal after start of performance

In the case of contracts for the supply of digital content not supplied on a tangible medium (e.g. online memberships, access to protected areas, digital services), the right of withdrawal expires in accordance with Section 356 (5) of the German Civil Code (BGB) as soon as we have begun to perform the contract.

In order for us to provide the digital services immediately, you expressly confirm during the booking process that we may begin performance before the expiry of the withdrawal period and that you will lose your right of withdrawal once performance begins.

Upon completion of the booking and immediate provision of the digital content, a withdrawal is therefore no longer legally possible.

2. Legal basis

This regulation is based on Section 356 (5) of the German Civil Code (BGB) in conjunction with Section 327 BGB as well as Art. 246a Section 1 (2) sentence 1 no. 1 EGBGB and permits the immediate provision of digital services.

3. Voluntary goodwill policy

Regardless of the legal situation, SOLID Information Management GmbH may, in justified individual cases, voluntarily offer a refund or credit – for example in the event of technical problems or obvious erroneous bookings. However, there is no legal entitlement to this.
